Hershey Wins Lawsuit Claiming That Reese’s Halloween Candies Aren’t Scary Enough

Reese’s has a great scam that they pull every holiday. Around the day, they’ll release some themed treat — they’ll say it’s a peanut butter and chocolate dessert in the shape of a football for the Super Bowl, or an egg for Easter, or a pumpkin for Halloween.


Then, you pull it out and it’s just some amorphous blob. What gives?


This is where a recent lawsuit comes in. Basically, in 2024, a group of concerned citizens sued Hershey claiming that the advertising they used to promote these blobs — namely, advertising that appeared to show the candies carved like Jack-o-lanterns — was deceptive.


Because this is the United States, a court actually heard this complaint and, after a bit of deliberation, decided that yes, Hershey can keep selling its Halloween candies without carving them up to match the photos.


While the court admitted that the advertised product looked different than what you got, they said that the “aggrieved” parties weren’t able to prove a “concrete economic injury,” seeing as they still got to eat the chocolate and peanut butter snack.


Again, because this is the United States, the people suing Hershey claim they’re not done with the lawsuit. They say they’re amending the complaint to better reflect their argument.


What does this mean for you? Well, in a few years, you might get an email asking you if you want to participate in a class-action suit against Hershey. Then, you can use your probable $2.97 settlement to buy more Reese’s.
